PETITION OF ELIZABETH WAGSTAFF TORONTO DEC 20-29 - ? 29th, ,1843 FOR A GRANT OF LAND


For the Right Honourable Sir Charles Theophilus Metcalfe H.C.B., one of Her Majesty's Most Honoured, the Privy Council, Governor General of British North America ? ? ?

The Petition of Elizabeth Wagstaff of the City of Toronto, Widow, humbly showeth that Petitioner is the disconsolate Widow of the late Robert Wagstaff who was admitted in ? Pensioner of Her Majesty's Royal Hospital at Chelsea on the 13th day of May 1817, from the Rifle Brigade, then commanded by Sir David Davidson and who served as a Soldier for a period of six years and five months, and was discharged in consequence of a Gunshot wound in the neck received at the Battle of New Orleans, having a Pension of sixpence per day.

Petitioner begs to state that her Husband and his family arrived in this country in the month of May 1837, and took up arms in defence of the Government at the City of Toronto in the month of December insuing; and notwithstanding his locating though and by means of former wounds (for he had received these severe wounds in different Engagements) and performed every duty demanded of him, in that time of peculiar exigency.

Your humble Petitioner further begs to state, that her Husband died on the 12th of August, last, leaving her in a most forlorn and distressed state with five helpless children to lament his loss and from that period up to the present she had been struggling hard to support her children, but in the present distressed times, she can scarcely get any thing whatever to earn so that unless your Petitioner is rendered some assistance towards the support of her helpless children she can with truth and sincerity declare that the misfortunes of herself and children will end in death by starvation.

Your Petitioner will further beg to state that her husband was induced to come out to this country on the positive assurance of receiving a "Grant" of the Waste Lands of the Crown but on applying therfor, he was informed that new Regulations had been adopted which excluded him from obtaining a Grant, unless a special order to that purpose could be obtained. Your humble Petitioner therefore believing that your Excellency has it in your power to grant her a "Lot of Land" for the purpose of assisting to support her children she humbly craves your kind consideration thereto and will humbly await your Excellency's answer; and your humble Petitioner as in duty bound will ever pray.
